Susan I agree, however when my clients call for records they get a 'clerk' on the phone that has no clue and is HIPAA shy.  I try to contact the Health Information supervisor to request records, but this is becoming difficult.  So, that is why the fax request.  I am having better results.  However; this is a VERY good point.  I think I am going to add this to the form.

The hospital and  LTC facilities have a TRANSFER AGREEMENT that allows copies of medical records information to be released WITHOUT a written authorization IF IT IS FOR CONTINUITY OF CARE.  THIS WAS EMPHASIZED this past week when I attended a HIPAA update State meeting that was presented by  Jill Callahan Dennis, JD RHIA.  .
