Of course, MP3s can be compressed to greater or lesser degrees and this 
can be misused. If you use a setting intended for spoken voice recordings 
for orchestral work it is going to sound terrible. If you the same 
setting for spoken voice it will sound fine and it would be silly to use 
higher settings. Different kinds of music (pop vs orchestral) call for 
different settings too.

When you encountered a bad MP3 did you look at its specs? 

You may be condemning MP3s with too broad a brush.
