Actually, no. As noted by Berin (PMC Chair), Fortress has not released by the Avalon PMC. Berin Loritsch wrote:

Hence I wonder whether such denial would hold up in court, but fortunately IANAL ;)
I find attaching too much meaning to the word "official" just leads to confusion, if not bureaucracy.
