Sorry but that's fairly standard legalese for our corporate umbrella and
is not really the defining document of how we, the ASF, achieve our
mission.  I don't disagree that finding "we don't pay for code" written
down takes digging. 

But it's a dead end argument to say that "not paying for code" isn't a
well-heeled and well-adopted proviso of the foundation.  The current
board however is certainly empowered to change that tenet but I expect
it would be controversial IMO with the membership let alone on the board
itself.  Likely why the board is treating the entire topic like a hot
potato.
