Why, have you not given him access to his data last day? You have, unless
he can prove the opposite. Right? :-) Or, I think you can give him a very
limited access, where there is only one empty index.html file. Can he
prove that that only file is not his website? He has no backup :-)

BTW, did you make a contract with this guy?
