I think it is entirely reasonable to offer existing domain holders
the opportunity to upgrade to the equivalent .ca domain before
anyone else is allowed to try to register it.   You won't get far
with your dispute I'm afraid....it's been this way a very long time
and rightly so in my book.

However, where I DO take issue with the existing rules is when two
registrants exist using the third level domain.   i.e.
domain.on.ca and domain.bc.ca    I feel that the domain which was
registered first should be first offered the ability to upgrade.
In the case of one of my clients, they had registered the .on.ca
version over a year ago.   Then some other person came along on
August 14 and registered .nf.ca    Note, it clearly states in
CIRA's documentation that you are only offered the ability to
upgrade if your domain was registered before August 1.  My client
feels entitled to be able to upgrade, but this is not the
case...and surely this would be a much stronger case than yours.
Our only hope is that the other registrant will agree to allow us
to register the .ca version.   I was told this morning by a very
courteous young man at CIRA that this would have to be done after
November 1 (he was nice, but NOT very knowledgable and had to ask
someone else the answers to all of my questions).
