As stated in other parts of this thread, the resellers associated with these
orders aren't really doing anything wrong.  The customer is binding
themselves to the terms and conditions for the domain (whether or not they
have a legitimate claim), and the process put into place is meant to help
prevent fraudulent transfers from happening (hence your explicitly required
permission).  If I went to Register.com and attempted the same transaction,
you'd simply deny the request.  Anything that falls through this process
falls to compliance (internally, or with other registrars where applicable)
to fix the problem - and even then it's less than 1/10 of 1% of transfers
that result in problems :)

I think the system works, and shooting the messenger might be premature.
