Yes they can.  I've gone thru this with them recently.  Your option is to
renew the domain with NS, then wait 45-60 days for the transfer.   OR, you
can renew and transfer immediately afterwards, but they won't transfer the
YEAR you just paid for...   There are probably other options but this is
what I had to do.
