http://www.nic.us/policies/docs/ustld_nexus_requirements.pdf On page 2 -- just above the description of Nexus Category 1 -- it says that the registrar must certify the following three things. <quote> -- Certification that Registrant satisfies Nexus requirement - if not completed, then registration will be rejected; -- Basis for compliance (Nexus Category 1, 2, or 3) - if not completed, then registration will be rejected -- Certification that the listed name servers are located within the United States - if not completed, then registration will be rejected </quote> I read this to mean that the requirement that the name servers be located within the US is in addition to the nexus requirements. Now, if you want to be very literal, requiring that the registrar certifies (at the time of registration) that the nameservers are located within the US is not quite the same as requiring that .us domain registrants never use non-US nameservers . . . but splitting those hairs will be left for someone whose legal department has a bigger budget than mine :-) -Winston
