No it couldn't.  That's like saying "If you try to get people
to buy your service by putting up a billboard, then I guess
it could be considered a 'scam'".  This is an advertisement.
Admittedly, the medium is distasteful, but that doesn't
make it a scam.

A scam is a fraudulent business scheme; a swindle.   To me,
"scam" is a pretty harsh word.  I agree completely that
Verisign's "Renewal Notices" are a scam; they parade as
invoices for services that have not been rendered...in fact
they are solicitations.  To the extent that it is not clear
that they are solicitations, they're a scam.  They purport
to be something that they're not.

In this case, there's no question that the sender was
soliciting the recipient's business.  While using SPAM
to advertise is distasteful to many of us (I would never
employ such a tactic), that doesn't make it a scam.

If you try to get customers into transferring domain names by spamming as in
the message below, then I guess it could be considered a "scam". There are
too many of these spam based domain registrars out there. I get two or three
such emails everyday.
