The (simplest) reality about this EU act is that the reseller is only responsible for delivering the consumer a good that conforms to its standard use and advertised specifications (could be colour, noise, width, power consumption, whatever ...). A hardware fault, unless it existed at the moment of the delivery, is not endorsed by this EU act.
