Unfortuntely, in the US the asshats in congress just extended copyright another 20 years (Disney freaked out because Mickey Mouse was about to become public domain) so I think anything before 1903 is ok. Mmm...sampled harpsicord. :-P

as i understand things (i am not a layer) you cannot sample without clearing, period. realistically speaking, i wouldnt worry about it unless you were mass distributing and/or selling your tune. i believe that its mostly the label's job to help you clear the samples if nessesary anyhow, depending on how big the label is.
