Regardless of whether or not the expiring reseller participates in  
the auction the domain will be put in auction at the time of expiry.

consent is not required

that is not correct. by not renewing the domain the registrant is  
forfeiting the ability to consent to anything other than to receive a

your understanding is more correct however the reseller does not need  
to participate in auctions in oder to allow a name to be auctioned. A  
reseller will however benefit from any domain that is sold through  
their instance of an auction.
