I can read the data from my EDR in my Toyota with the Toyota OEM Service software and cable. However, I could never use the data in court because technically, I am not licensed to have the software or tool. Only Toyota is supposed to have it or licensed shops (and I’m guessing insurance companies). The software is about $2000 a year and the cable is about $400. So a low cost shady company probably doesn’t have or want to spend the money for these tools.
That said… I’d see about taking your insurance company to small claims court. I’ve never heard of anyone being blamed for being at fault while they were struck from behind. You can also file a claim with the State Insurance agency that oversees the company’s license. This will DEFINITELY get your insurance company’s attention and make them reconsider going after the other party.
