Well, remember the important secondary question... "Where?".  I don't 
have to deal with "appears to be", I can say with certainty that for 
me, it would be legal to fire up D-STAR on any ham band from 160m up. ;)

Agree there, manufacturers should be able to let the users 
decide.  Afterall, they've been enabling 16 kHz wide FM (5 kHz 
deviation) for years on HF boxes on all bands.  Over here, that mode 
is not legal below 28 MHz (it exceeds the 8 kHz bandwidth limit we 
have on 160 - 12m).  I suspect a similar story in the US (though for 
different regulatory reasons ;) ).

Well, only thing stopping me is the money required, otherwise I'd be 
in there giving it a whirl. :)
