I work hard at my journalism -- both my writing and photography. I also
spend a lot of time re-reading the copyright act. I don't consider
using a photo of mine in a presentation theft. To call it such is
hyperbole, in my not-so-humble opinion.
Copyright -- in U.S. law -- does not prohibit any use. That is why
guidelines on "fair use" are given. Frankly, to prohibit any use runs
counter to the original Constitutional intent of the copyright provision.
I do appreciate being asked permission to use my photos, but I usually
grant such requests.
Would use in a presentation harm the commercial potential of my work?
Probably not. If proper credit is given, it might even enhance the
commercial potential of my work by making more people aware of it.
Unauthorized use in a publication or on a Web site -- where the photos
are available for a significant amount of time -- or unauthorized sale
by a third party would harm the commercial potential, however, and would
attract my ire.
Would I sue someone for copyright infringement? Well, if most of you
were using it in a presentation, no. I don't have the deep pockets to
afford lawyers and you probably don't have deep enough pockets to pay
enough to do more than minimize any ensuing debt to my lawyers. If it
appeared on a poster or in a book without permission, however, I
probably would take you to court.
