Per R&TTED you are correct.

However, the EC TCAM body set up to decide practical interpretation of
issues with R&TTED have officially taken the position that the original may
be displayed on website with URL reference supplied in manual.  I have
verified the position with Manfred Mall (TCAM chairman) in the past
directly. 

The EC policy on R&TTED is meant to be a practical one, which removes
barriers to trade in accordance with the New Approach Directive.  There are
several practical variations to the R&TTED, published by TCAM, which one
would not discern directly from the legal text within the R&TTED.  Ref TCAM

I do not agree. From a legal standpoint, a URL is NOT a declaration of
conformity, and it is a legal requirement to provide a declaration of
Conformity to the user. The R&TTE directive requires that "the declaration
of conformity" be shipped with every product. (Note this does not apply to
all directives, notably the EMC directive).The EC agreed that including a
signed image within the documentation presented issues, so they allowed
manufacturers to put "a declaration of conformity" statement in the user
manual, and provide the contact point where the original signed declaration
may be obtained.

 What information has to be given to the user by the manufacturer?

      The declaration of conformity (DoC) must be included with the
product;. It is recommended to  
      conform to EN 45014.

      The product, the packaging and the documentation must bear the
appropriate CE marking and,    
      where appropriate in the case of some radio equipment, the "alert
sign"                       
      The intended use of the equipment must be stated so that the user can
use it in accordance    
      with its intended use. If necessary, information on the installation
of the equipment must    
      also be provided.

 

 

 For telecommunications terminal equipment, the manufacturer or the person
responsible for placing  
 the apparatus on the market shall provide information for the user on the
intended use of the      
 apparatus. Such information shall be sufficient to identify notified
interfaces, of the public     
 telecommunications networks, to which the equipment is intended to be
connected. In which form is  
 the responsibility of the manufacturer as long as it is prominently
displayed.                     
 

 

 For apparatus that makes use of radio frequency bands, where their use is
not harmonized throughout
 the Community, information shall be prominently displayed on the package
and the instructions for  
 use. It shall identify the Member States or the geographical area within a
Member State where the  
 equipment is intended to be used. In which form is the responsibility of
the manufacturer;         
      The equipment must bear a type, batch and/or serial number and the
manufacturer's name;       
      In the case of terminal equipment, the information on use supplied on
the packaging and in the
      instructions for use must be adequate to enable the user to ascertain
to what interfaces of   
      the public telecommunications network the equipment is intended for.

      In the case of radio equipment, the information on intended use
supplied on the packaging and 
      in the instructions for use must be adequate to enable the user to
ascertain in which part of 
      the EU it may be used. This includes any potential restrictions on use
in (a part of) a Member
      State (e.g. a license requirement).

 

 

 Should I include a copy of the signed declaration of conformity as part of
the user information?

I agree with Paul.  It is usually very difficult to print the DoC in the
users manual.  Ordinarily, the manual is approved and goes to print before
the final testing of the product and certainly before the DOC is signed.

One solution we have used is to print all the compliance information in the
manual -- with respect to all jurisdictions, not only the EU.  This
compliance information contains the same technical info as the DOC and
lists a url where the signed DOC can be found.

This is the position in the EU under the R&TTE Directive, as well as
LVD/EMC.  (The R&TTED replaces these directives for equipment within it's
scope.)

Annex ii paragraph 2 of R&TTED states concerning DoC and TCF:

Where neither the manufacturer nor his representative is established within
the Community (i.e. EU), the obligation to keep the technical documentation
available is the responsibility of the person who places the product on the
Community Market.

It is possible to keep copy of the original DoC on corporate website, and
refer in user manual to the website, rather than paste copy within every
manual.

EC Europa website gives plenty of finite detail on these issues.

And the answer is........................

The D of C must be signed by the responsible person designated by the
manufacturer. The signatory does not have to be located in the EU.
The manufacturer must designate a representative in the EU who will hold
the certificate and the technical file. This could be an agent,
distributor.
A copy of the D of C that states the directives complied with must be
placed in the user manual. Note, this does not have to be signed, but it
must state where the signed original can be obtained. i.e. the EU
representative's contact details.
