Manufacturers are entitled to claim (and document) that, based on your reasoning. The EMC Directive does not mandate testing; its only requirement is that the emissions and immunity are such that the 'essential requirements' are met. There is no need for emission testing, but, of course, immunity testing is likely to be required.
