For Europe, they are required to comply with emission requirements.

I hope so; that IS the correct standard.

Manufacturers are entitled to claim (and document) that, based on your 
reasoning. The EMC Directive does not mandate testing; its only 
requirement is that the emissions and immunity are such that the 
'essential requirements' are met.

There is no need for emission testing, but, of course, immunity testing 
is likely to be required.

I often point out to clients that all-analogue solutions, not only in 
audio, can save testing costs and speed time to market because of this 
consideration.
