In the context of WEEE/RoHS, but perhaps with a more general application to the CE Mark and other Directives, what is the position regarding refurbished product?
I assume the answer is that a product that has been refurbished is being placed on the market again when it is sent back into Europe. It is somewhat possible for a counter position that it was placed on the market when it was new, and this 2nd life doesn't count.
