Yes, that isn't 'stand-by' (see below about clocks, door bells, etc.). So is it functionally necessary for your product to be 'always on'? If so, you do not need a switch at all, as long as the mains plug acts as a disconnection device. Furthermore, it is not mandatory to provide a 'stand-by' mode. If it is not functionally necessary to have a 'stand-by' mode, fit a proper mains on-off switch on the front of the product.
