No-one can give you an unqualified 'yes' except a judge after a court
case. The best you can do is create a *defensible* position, on which,
if it came into court, you attorney could base a convincing argument.
Purchase Prints
Additionally, our company purchases all parts from a Purchase Print
document which includes "RoHS compliant" requirements on the parts we
need. Again, our legal advisors feel that Purchase Prints become a
Contractual Agreement with our suppliers. We also have a Supplier
Acceptance Program within our Purchasing Department which approves
suppliers based on a list of quality requirements.
So would you agree that a Purchase Print showing a part must be RoHS
compliant would satisfy the documentation requirement of the
directive/standard?
Same answer: fully document what you've done in order to attempt to
conform to the vague or apparently over-onerous demands.
In the case of Purchase Prints, you can ask for letters from your
suppliers confirming that they understand and accept that the Prints are
integral parts of the contracts you enter into with them.
