bigwigs, but anyway I'm nominating you to be the next director of the FAA.
Maybe then we'll get some relief.
I'm not going to get into the legality of an owner making a part when they
are still available through the manufacturer, or the fact that there are
probably no drawings or engineering data to support making some parts, or
the actual intent of the regulation when it was put into place. Let's allow
that sleeping dog to lie and not stir up a discussion because eventually the
little guy always loses, beleive me. Regardless of what an FAA inspector's
written opinion states and what you choose to beleive, let's just leave it
alone so it can float in the muddy waters it has entered. So far it's been
good for all of us.
In this litigious society, it would be very easy for either the victim or
victim's estate of an airplane accident to quickly have a service conduct a
professional Google search for anything related to the plane, the type or
part that may come into question. For example, if a fire was started due to
a ruptured tank, any tank, and it was found that a tank was put together
from stock, it would indeed raise the question of who checked it and what
specific qualifications they had, and are they better than the expert
qualifications of the person brought in to testify? However any doubt can
be cast onto anyone else other than the victim will help the case.
I have an acquaintance who is active in the warbird community. One of the
planes he loves is the T34, the Beech Mentor trainer. Not long ago, some
silly combat school probably (no, definitely according to the VHS tape),
operated this 40+ year old airframe way out of the envelope causing a wing
to separate, decapitating the customer occupant and crashing killing the
pilot. This gentleman owned that particular airplane many years ago and
retrofitted it with a larger engine, according to an accepted STC (a real
one!). He was named in the suit as a person who modified the aircraft.
Although eventually dropped, his legal costs exceeded $225,000. In the same
suit, the estate is personally suing each and every one of the victim's
friends that came along for the action that day. Sick? How about this -
same guy was also named in another Mentor accident suit because he was "A
Known Enthusiast" of the type. A quick payoff of $75K made that one go
away. The guy has deep pockets, so the lawyers go after him just for shits
and giggles.
So, you think a casual mention on a little email group can't be brought back
to life? Think again. Think again, then think again.

Think that the FAA or the Homeland Security will scan articles for
violations to the FAA rules?
Big brother watching and PUNISHING you?
I understand that if you are the owner of an aircraft you can provide and
make parts for your plane.
Right?
Of course when it goes structural one should assure in his/her own
interest
the required quality.
A stainless steel tank is in my eyes an improvement.
