OK guys, I won't warn you any more, as usual lawyers are always correct.  Even 
though I only stated my impression.  With lawyers always looking for a reason

throw enough poop it will stick. Let the man sell his airplane and let the 
buyer make the prudent decision.

But stating that somebody is deliberately making 
misrepresentations.....Somebody might call that SLANDER.  That is my 
professional legal opinion.
So, perhaps for us to be a bit more circumspect in publicly slamming personal 
reputations would be a better approach.

After all, this plane probably is NOT a model "D" so it probably IS a model 
"C." That is likely why the data plate says "C".
There is essentially no other option.  
If he bills it as a "D" model, some folks will gripe.  If he bills it as a "C" 
model, some folks will gripe.
It seems that by the standard used below, he cannot be honest, no matter what 
he says.

Maybe some Prozak would help.  We really seem to be getting obsessed with this 
amateur lawyering over the D / C / LSA blither.
If you've been Coupes around long enough, you know that it was once popular to 
gripe that folks were dishonestly selling so-called "D" models that were really 
"C" models because the airworthiness certificates said they were '"C" not "D."
Now the very same planes are in the reverse situation.  So, now what, coach?  
It's gotta be one or the otherrrrrr!

Subject: [ercoupe-tech] Ercoupe Model C inaccurately advertised on ebay

  Just a heads up to all, a fellow has an Ercoupe advertised on ebay as a Model 
C in large letters, but it is not.  Down in the ad he states it is not a LSA 
model, but knowing from experience that some folks don't read the entire ad 
they just look at the headline, it is possible for it to be sold as a C.  I 
have sent him 2 messages suggesting he change the headline to say it is what it 
is.  His reply has been that the data plate says it is a Model C.   My 
interpretation is that he is purposely misadvertising the plane.
