James I whole-heartedly support your points and wish to see a change to open source, BUT, I don't think we can overcome the momentum of a well entrenched status quo and support from a large corporate donor, at this time.
Taking for granted what Seymoor said about the EPL being tied into the rest of city IT, a la, 9/11 and Homeland Security, this is just the tip of the iceberg.
