That is why the (serious) scientist will just claim that he did not find evidence for telepathy, and never clued from this that telepathy does not exist. To make an experience showing that telepathy does not exist would be much harder. It might be proved, though, in *some* metaphysical theory, which might or not be indirectly confirmed or refuted. The problem here is that most scientists concluding they have tested telepathy positively have up to now been shown having loopholes in their protocol, when they were not just abused by a magician, like some confessed later. Then, a bit like with free-will of god, some people gives definition of such concept which can only be rejected as non-sensical, or based on premise which directly contradicts our better theory, like when people described telepathy as instantaneous action at a distance, which would require even more sophisticated experimental protocols which do not yet exist. The problem is only when people stop to doubt, and talk like if they knew the truth. That is both unscientific, and even un-religious (arguably).
