Only if they have protected it adequately, by using the trademark properly (as an adjective, not a noun) at all times and by agressively prosecuting every unauthorized use of the trademark. Otherwise, it can fall back into the public domain, as happened with former trademarks aspirin, cellophane, and, interestingly, heroin.
