Fink's builds are _supposed_ to be consistent, barring changes in the
system, even failures.

It's due to changes in Java that Apple made before 10.6.5, which affect
individual java-using packages.

Are you _sure_ that you're using the unstable tree?  If you didn't
selfupdate after turning on unstable, you may not have downloaded the
unstable tree package descriptions.  I get the following on
10.6/unstable at the same point:

checking if java include directory given... yes
Java directory
/Library/Java/JavaVirtualMachines/1.6.0_22-b04-307.jdk/Contents/Home exists
checking for javac... yes
checking if java OS include directory given... yes
Javaos directory
/Library/Java/JavaVirtualMachines/1.6.0_22-b04-307.jdk/Contents/Home/include
exists

so I suspect that you may not actually be using the unstable package
description.  You can confirm this by running

fink dumpinfo -finfofile emboss
