..both are viable arguments in the "redlineit" case.
Facts can be found by fetching the screen shots off both sites 
and md5sum etc them all.

..exactly.  Under copyright law, the question is, who ran the 
program to make, or "author" those screenshots?

..other than copyright law, any and all licenses covering the content, 
and case law, under which we find the US "fair use" doctrine.
