I recognize a substantial amount of publicity has been generated again in the last 24 hours regarding the wall. To prevent any misunderstandings I want to clarify the Town has an enforceable agreement in place that dictates how the project is to be completed. The major outstanding issue is the required construction of a four foot architectural wall. We intend to enforce this agreement and will go to court to protect the Town's position in this instance. The larger wall (which is currently in place) cannot and will not be removed as it is required in the enforceable agreement. I trust this will answer the pertinent questions currently being raised.

He and I talked for a few minutes and I would have to characterize the conversation as cordial and civilized. The current situation (as I understand it) is that all of the components of the contract regarding the Wall have to be completed by end of business this Thursday. The Great Wall was lowered and the survey work was completed to show that the Wall is no higher than 506 feet above sea level. (The total height of the Wall by my estimate is a total of 15 feet but earth was placed at its base so that only six feet is visible above ground.) Chris has apparently decided to remove the entire wall instead of adding the second architectural wall agreed to in the contract with the Town. He wants this done by Thursday. The following message from Kathy Vassar asks most of the questions that this new information begs. In addition, I have one more question which will also need to be answered: What will happen to the section of the Wall which is below grade (which I claim is eleven feet deep)? As for the questions from Kathy below, I am probably most concerned with the last one. We may now go off and speculate why this strategy is suddenly being persued. My answer is: Who cares? As long as it's being done properly and according to the regulations. But I will still want to see all the answers to the questions raised here. ---------- Forwarded message ---------- Date: Mon, 28 Jul 2003 18:17:20 -0400 From: Kathy Vassar <[EMAIL PROTECTED]> Subject: great wall I just had an interesting discussion with Craig McCormick of the News. According to him CK has decided he is going to remove the 6 ft wall before Thursday. If true this raises several questions. -does this violate the agreement with the town? -is there a new agreement with the town? -has there been or will there be an engineering plan to make sure that any new plan will not create additional problems for the abutters? -does he need a permit to remove a 6 ft wall? -what happens to the tons of fill that were brought in and contained by the wall?
