I agree.  If this were the case, we could all sue Microsoft for their
sockets implementation.

Ummm, violation of what exactly?  The code you are talking about
isn't--and never has been--licenced under anything but a proprietary
licence.

However, you recieved a snapshot of some code;  which they kindly gave
to you under the conditions set forth in the GNU GPL.  (ie. That *you*
would never change the licence).

There, does that make better sense?
