because many problems are intermittent.  if a user has gone through the
b.s. tech support stupid human tricks and it won't work reliably, then
it's broken.  

i've fixed equipment before (an expensive, lab grade mass flow system)
that the manufacturer insisted was fine after their "thorough" bench
testing, unfortunately it wasn't thorough, and a simple visual check
might have led them to suspect the problem in their unit that i found
trying to fix noise in the data acquisition system- namely a transformer
that had an insulation defect (a great big burned bubble, probably due
to a surge) and was leaking current into the outputs (which wound up
finding ground through the data acquisition card, producing considerable
data noise but not doing any permanent damage to it, amazingly enough). 
this is also why the flow was unstable, yet in the boring environment at
the manufacturers with slightly retarded techs it appeared perfectly
fine, at least as far as they tested it.  

the fact is i've seen genuine intermittents that sometimes took days to
show up and then might show up constantly for some time before magically
disappearing again, for awhile at least.  none the less i was eventually
able to track down the problem and permanently banish them (for years at
least...).  the fact is many warranty claim departments do such a poor
function check that the unit in question practically has to burst into
flames and dance around for them to notice it.  on the other hand, it's
not at all hard to permanently break it in a way that doesn't look like
abuse, but you shouldn't have to cheat just because they do.  sometimes
a good tech just has to spend the hours waiting for equipment to finally
act up, but most manufacturers know we're all wombats who probably just
forgot to plug it in.
