if no disks are included. Unless they mean "discs" as in the install
DVD media is not included. If that's the case it makes more sense but

This model shipped with OS X 10.3.7. It is possible that Apple may
still have the original DVD media, that contains Panther and the
bundled apps. If they do, then they'll only charge you a modest
replacement fee.
That they've put Leopard on it is fine, but then they should be
including the media! If they're not including the retail Leopard
discs, then that makes the copy of Leopard on the machine *pirated*.
Not cool.
