It's not just the movies though. THe names of characters and places in Lord
of the Rings are also copyrighted. Just because Phil got away with using
Pacman and place names from Harry Potter in his games is no guarantee that a
Lord of the RIngs game would fare the same way. Even releasing it as free
and even open-source material is no guarantee of protection.

You might not have to use the music and any of the copyright meterial from
the movies, but on the other hand finding actors might be hard, so i
totally understand if it's a lot of work.
