It's pretty much the same argument that SCO is using against Linux. It goes like this: the source code for UNIX influenced the developers at IBM who worked on Linux. Therefore, SCO owns the technology that produced Linux and has all right to claim ownership of it.
Tin-foil hat logic says that MS released the source on purpose.
