How is "neither convinced nor not convinced" different than "not yet convinced"? You seem confused. The judge has not ruled one way or the other as to whether sufficient harm has occurred to find for the plaintiff, but he has determined that there is not any grounds yet presented to warrant an injunction. You are still losing on this one.
