Is this an admission of your failure to rationalize Jacobsen's failure
to file an amended complaint within twenty days (noted: you have
mentioned it several times in that time that an amended complaint might
bring some rationale to the table), Hyman? Will you stop your misleading
practice of referring to the Jacobsen's case, then?

To be fair, the case itself has not been litigated yet. The issue here was simply regarding a preliminary injunction. Jacobsen may have come to the realization that he was not going to get an injunction without spending far more money than he had in his pocket. He was on a losing streak, after all.

If/when the case goes to trial and judgement, there will be a lot more to say.
