Further to my response on above subject and for the information of Marshall, Supreme Court had ordered that Mohammed Afzal be hanged on October 20, 2006 when BJP was not in power. But UPA Home Ministry sat over Afzal Guru's mercy petition and did not send the petition to President A P J Abdul Kalam till his last day in office. To read what our respected ex President A P J Abdul Kalam had said, on his last day as President of India, click the link provided:
http://indiaabroad.com/news/2007/jul/27parl.htm Under directives of Soniamia, UPA Home Ministry preferred to send the file to Delhi government under a pretext that the petition requires the views of the state where the crime has occurred. And Delhi government, again under instructions of Soniamia, till date, is seen not in any hurry to convey its view on the file/case. In fact, the file has not moved at all. It is obvious that the delay is Soniamia. Short recital of Afzals case: Mohd. Afzal Guru, the terrorist played a leading role in the joint attack by the Lashkar-e-Toiba (LET) and the Jaish-e-Mohammad (JEM) of Pakistan on the Indian Parliament on 13 December, 2001. The terrorists in this brutal attack had killed seven members of the security force, including a lady constable. In this context it is worthwhile to re-read the words of former Chief Justice of India R C Lahoti, who spoken on his last day in his office, as was reported by The Pioneer, dated Oct 17, 2006. Justice Lahoti said "Which penalty is required other than death for this dastardly act? What other punishment is called for? We forget the past.... Human memory fails..... We forget the victims and we only see the accused before us and his family.... We forget the family of those killed, injured and totally uprooted, and I am told of a family whose only surviving member is a small child. People say that death penalty is the only punishment in which you cannot give life back. Ask this man who is the mastermind behind this blast. Can he give the life back of those killed? We forget thousands of those killed and think of only one person. Keeping in view my judicial experience, I personally am of the opinion that it should continue in the Indian Penal Code". Finally, one question to our brilliant Marshall: Now tell me whether Afzal should be hanged or UPA government? Marshall, study the case and come back to this forum again. Best regards, Dr. U. G. Barad
