I think you'd be OK.
If you're thinking about loading your KML into maps.google.com then it
would be the same as when you create maps with "My Maps" and mark them
as private.

If you're thinking about loading your KML into a mapping application
that uses the Google Maps API, then it is the good old debate of "the
letter vs. the spirit" of the TOU, in which case I go by what I
believe to be the spirit, but most folks here go by the letter.
