I see no legal problems whatsoever in just hosting KML files. KML is just an open file format that Google has published. It is becoming a common format for geographic data, just like ESRI's shapefile format is. Neither Google nor ESRI have any proprietary interest in the content of such files, unless they produce the content themselves.
