I would say (see my earlier post) that you are using the API in a service which does not *require* a subscription or restricted access [in fact your login isn't really a restriction if it's free and easy to get] and the fee isn't charged for services provided via the API, because if you don't pay a fee you get the same API service as if you do pay. "You may not the API for any service for which a fee is charged." That's fine. The services for which you are charging don't use the API. I don't see a problem. Take an example of real-estate listings: getting a map with pins of available properties is free, and it's permissible to charge for the opportunity to place a pin on the map. You can even provide a restricted-access administration page which allows your paying customers to maintain the position of their pin. That's in the FAQ at http://code.google.com/apis/maps/faq.html#tos_commercial and http://code.google.com/apis/maps/faq.html#tos_password. That example is far more borderline and debatable than your proposal, and yet it's given as an allowable use. In my opinion, which should not be taken as definitive legal opinion.
