Andrew, IMHO, you are interpreting the example in http://groups.google.com/group/Google-Maps-API?hl=en too liberally.
Yes, it says, this: "If you charge people to place information on your map (e.g. to list their homes for sale), but you display this information using the Google Maps API on a free part of your site, you'll also meet the Google Maps API ." That does not mean that you give those restricted, paying customers an API-based interface "to place a pin on the map." These customers could just be listing the addresses in the web site's back-end database. If the site then displays the database items publicly using the API, that is okay. But that is not the same thing as providing these customers an API interface directly for this purpose, which would be out of bounds. You cannot give them use of the API that is not freely available to everyone.
