You can search for "New Streetmap Tiles" and "little brown icon" for several threads on this. The little brown icons are "painted on" the new version of the map tiles for API maps, as they have been for Google Page maps for about six months or so. That is, they're part of the map tile art, not an overlay like Wikipedia icons. In Google Maps, there is a layer for, I guess, the invisible markers that correspond to the embedded icons. But we don't have the "info layer" available in the API. Just the useless and confusing icons.
A lot of them are off, some by hundreds of feet. I asked about this a while back in the Google Maps group and got no expert answer. So, the answers... 1. Nope, They're part of the map time art. 2. No one knows how they were created, or from what (crudely sloppy) data. Several posts here have never been answered by any google folks.
