You can always zoom above maxResolution by setCenter().
A was playing with a button that triggers
map.setCenter(map.getCenter(), map.getZoom()+1);
and it appears that there are map tiles even at zoom level 22 in
Brisbane area.
Actually you can zoom up to 22 anywhere. Even on oceans or Antarctica.
Only zoom level 23 and above return 'sorry'.
