Mr. Gilmartin is being opaque: the lawsuit was over Domino Foods (owned by Amstar) vs. Domino's Pizza. Both, doh, use the domino symbol; both serve food (let's not digress into whether Domino's pizza qualifies as food!). Amstar won the suit but lost on appeal.
