Journals and conference proceedings do permit authors to upload their papers on their websites. Some authors do so, while others don't. There are professors who also do release their work as free/open source software. A recent one that I encountered: http://www.cprover.org/svn/cbmc/releases/cbmc-4.2/ Of course, some industry-sponsored projects have their own terms and conditions. What is required is to make people aware of how to do it the free/open source way to benefit them and others.
