Additional comments: It is probably a good idea that the server not accept SMTP commands without receiving the EHLO/HELO. In this case it seems there is a hole in the RFC in my opinion. In the Mail From/RCPT To sequence it is specified what the server should do in the event things are of sequence. This is not so in the case we are talking about here. One might think it is implied and could possibly be interpreted as you (and I am sure others) are saying. I thought the whole idea of RFC's is to take the guesswork out of things.
