It is interesting that the person who wrote the article is more concerned for
the broadening of shame away from "truly harmful vices". There is, however,
another very important point regards the sinner which is even made in the
context of ancient Biblical law in Deuteronomy:

"Deuteronomy 25:2-3  2 If the guilty man deserves to be beaten, the judge shall
make him lie down and have him flogged in his presence with the number of lashes
his crime deserves,  3 but he must not give him more than forty lashes. If he is
flogged more than that, your brother will be degraded in your eyes."

While the punishment of flogging is recognised as barbaric today, the concern
not to degrade or humiliate the offender is a truly spiritual point. This shows
that a utilitarian approach to punishment insufficiently appreciates aspects of
justice that were known even in ancient Israel and understood to be "of God."
The dignity of the sinner seems to be irrevocable in God's eyes.
