Ok. So the second IOIO board is showing the latest firmware? And still 
behaves inconsistently? Did you apply external power to the board when 
doing the firmware upgrade(s)?

I too am running 8.1. Does everything checkout OK in your device manager 
meaning IOIO OTG is shown under PORTS (COMM & LPT)?
