IMHO, that code is no correct (even if it behaves correctly): booleans should
be manipulated with logical operators.

But it makes the code obscure. I think that there is hardly any use for
bit-wise operators in Commons Math.
Someone examining the code should not be obliged to write down truth tables to
figure out when the alternative will be executed.
